Hi. heres the deal my husbands ex wife recently found out that he got remarried and flipped her damn lid and took the child away and wont let him see her, so we filed contempt charges on her and in the midst of this she presented the court with a paternity test naming another man as the father. thats all well and good becuz my husband questioned it anyway. this other “dad” was supposed to file papers to have my husbands name removed from the birth certificate and to start taking full responsibility but as im sure you can guess that has not happened. so in the mean time, were still paying retarded amounts of money for this child and shes not even his nor does he get to see her. how is this even allowed? and child support enforcement said that even when his name is removed from the birth certificate he could possibly still have to pay for her…. what the hell is really going on?
well lets get this clear, i have a child myself and have a very good relationship with the father, i am not complaining about the “instant family” nor am i complaining about the money being paid for a child when he thought it was his child, i simply wanna know why its ok for him to have to pay for a child thats not his? and why he would have to pay even after he is not on the birth certificate? our lawyer is handling it but its a long process and i want to know other peoples opinions!
our is handling it and giving us answers to questions, but i was getting upset with him when he said all of this so i figured id get other people OPINIONS, she knew from day one that he wasnt the dad but didnt tell him til recently.

too bad. that’s what you get for marrying into an insta-family quit crying and just deal with it.

Talk to an attorney. His ex sounds like a skank. Women like her make me sick because they make the rest of us look bad. I would take her azz back to court and demand repayment of the child support I already paid. Good luck.

Welcome to the life of men. Family laws do not work for fathers, especially non-custodial ones. Sucks, but this is the way it is.

you should go to a lawyer and ask. Every state can be a little different but its good to know what your up against and get educated on the situation. Poor child I bet this is going to mess with her.

When someone begins to pay for a child there’s some presumption of responsibility. It can continue, even if the person is later proven not to be the parent. That’s what CSE is talking about. On the other hand, it can be fraudulent if she knew all along that he wasn’t the dad. You’re just going to have to wait and see what happens. I’m not an attorney, this is just info I’ve picked up through 26 years in the CS system.
EDIT: Why hasn’t your attorney answered these questions?

I need detailed info on this case sent to me.
In 20 years, I’ve never heard of such a case. When a mother uses DNA evidence to block parental rights, she always loses any claim on child support.
This is a case we can take to the media. It shows an additional side to the problem of paying child support to a non-biological child. She can use DNA evidence to stop his rights, but he can’t to stop child support.
Have you considered getting a lot of friends together to picket her home and job? IT’S LEGAL AND FUN TO DO.
